1. Acceptance of Terms

By accessing or using https://proxyhat.com (the "Service") operated by ProxyHat — Individual Entrepreneur "Sagat", registered in the Republic of Kazakhstan ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms").

BY USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

2. Eligibility

You must meet all of the following requirements to use the Service:

3. Accounts and Registration

  • Provide accurate, current, and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept full responsibility for all activities under your account
  • You may not transfer, sell, or share your account with third parties
  • You may not operate, control, or benefit from more than one account — multi-accounting is strictly prohibited
  • Abuse of free traffic, trial allowances, promotional codes, referral bonuses, or any other free benefits is strictly prohibited
You are solely responsible for any activity that occurs under your account.

4. Services Provided

ProxyHat provides proxy services on an "AS IS" and "AS AVAILABLE" basis, including:

Residential ProxiesReal residential IP addresses
Datacenter ProxiesHigh-speed datacenter IPs
API AccessProgrammatic integration
We do not guarantee uninterrupted service, specific uptime percentages, connection speeds, IP availability, or geographic coverage. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

5. Payment Terms & Refund Policy

💳PAYMENTS ARE FINAL ONCE THE SERVICE IS DELIVERED

Payments become non-refundable once the purchased traffic or access has been delivered to your account. Billing errors, duplicate charges and undelivered service are refunded in full.

EU/UK Consumers: Waiver of the Right of Withdrawal

Traffic packages and proxy access are digital services performed immediately. At checkout you expressly consent to immediate performance and acknowledge that you lose your 14-day right of withdrawal once delivery has begun (Art. 16(m), Directive 2011/83/EU and equivalent UK rules). This consent is confirmed to you on a durable medium (e-mail receipt).

Payment Terms

  • All fees must be paid at the time of purchase
  • Payments are processed via secure third-party payment processors
  • Prices are subject to change at any time without prior notice
  • You are responsible for all applicable taxes

For risk-management reasons, larger purchases paid by card may be delivered in scheduled installments disclosed at checkout. Installments are released automatically while the account remains in good standing; a payment dispute cancels all undelivered installments.

What is not refundable

Exceptional Circumstances

In rare and exceptional circumstances, refund requests may be submitted to our Legal Department for review. Any decision to issue a refund is:

  • Made solely at the discretion of our Legal Department
  • Not guaranteed under any circumstances
  • Final and not subject to appeal
  • Based on criteria determined solely by ProxyHat

BEFORE YOU FILE A CHARGEBACK: If a charge looks wrong, contact support@proxyhat.com first — billing errors are usually settled the same day, and unused traffic can be refunded in full. Opening a dispute with your bank instead suspends your account and its remaining traffic until the dispute is resolved. We reserve the right to report fraudulent disputes to the relevant authorities.
A chargeback also suspends any associated accounts that we link to yours by device, network or identity signals, together with their remaining traffic. Suspended accounts are reinstated only if the dispute is withdrawn by your bank and the funds are returned to us.

Subscriptions

  • Recurring subscriptions are billed automatically until cancelled
  • Cancel before renewal to stop future charges
  • Cancellation does not entitle you to any refund
  • No pro-rata refunds for mid-cycle cancellations

6. Acceptable Use Policy

You agree NOT to use the Service for any prohibited activities:

✕ Illegal activities under any applicable law✕ Spam, phishing, or unsolicited communications✕ Network abuse, DDoS, or malicious traffic✕ Violating third-party rights or privacy✕ Circumventing security measures✕ Distributing malware or harmful code✕ Scraping in violation of website terms✕ Any activity harmful to ProxyHat
VIOLATION CONSEQUENCES: We reserve the right to immediately suspend or terminate your access for any suspected violation, WITHOUT REFUND.

7. Service Modifications and Termination

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Terminate your account at our sole discretion, with or without cause
  • Change pricing, features, or service specifications without notice
  • Impose limits on usage, bandwidth, or features
IN THE EVENT OF TERMINATION FOR ANY REASON, YOU ARE NOT ENTITLED TO ANY REFUND.

8. Intellectual Property

All content, trademarks, logos, software, and intellectual property on the Service are owned by ProxyHat or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF KAZAKHSTAN:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF KAZAKHSTAN:

  • PROXYHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • THIS INCLUDES LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
MAXIMUM LIABILITY: IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

11. Indemnification

You agree to indemnify and hold harmless ProxyHat from any claims, damages, losses, or expenses arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or applicable law
  • Any chargeback or payment dispute you initiate

12. Dispute Resolution

  • Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us
  • Exclusive Jurisdiction: Any disputes shall be resolved exclusively in the courts of the Republic of Kazakhstan
  • Waiver of Class Actions: YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE PROCEEDINGS
  • Time Limitation: Any claim must be filed within one (1) year or is permanently barred

13. Governing Law and Jurisdiction

These Terms shall be governed exclusively by the laws of the Republic of Kazakhstan. You irrevocably submit to the exclusive jurisdiction of the courts of the Republic of Kazakhstan.

14. General Provisions

  • Severability: If any provision is held invalid, the remaining provisions continue in effect
  • Entire Agreement: These Terms, with our Privacy and Cookie Policies, constitute the entire agreement
  • Waiver: Our failure to enforce any provision is not a waiver of that provision
  • Assignment: You may not assign your rights without our consent
  • Force Majeure: We are not liable for failures due to circumstances beyond our control

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use constitutes acceptance of the revised Terms.
